StemCyte, Inc. ("StemCyte," "we," "us," or "our") respects your privacy and is committed to protecting personal information entrusted to us. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information obtained through our websites, services, communications, and business operations.

This policy applies to personal information collected online and offline, including through our websites, customer service interactions, enrollment processes, and marketing communications.

Section 1

Categories of Information We Collect

We may collect the following categories of personal information:

  • Identifiers: Name, address, email address, phone number, IP address, account identifiers.
  • Sensitive Personal Information (SPI): Government-issued identification numbers, health-related information, pregnancy and delivery details (including expected due date), and other information necessary for newborn stem cell banking services.
  • Reproductive or Sexual Health Application Information: Where you provide pregnancy-related information through our website in connection with our cord blood and cord tissue banking services, that information may also constitute "reproductive or sexual health application information" under California's Confidentiality of Medical Information Act (CMIA), as amended by AB 254 (effective January 1, 2024).
  • Commercial Information: Products or services purchased or considered.
  • Internet Activity: Website usage data, cookies, analytics data.
  • Professional Information: Employment-related information (employees only).

We do not knowingly collect information from children under 13 years of age.

Section 2

How We Use Personal Information

We use personal information for the following purposes:

  • To provide requested services, including enrollment, storage, and customer support.
  • To communicate regarding accounts, transactions, and service updates.
  • Service-related communications regarding your enrollment. Where you provide an expected due date during enrollment or while beginning an enrollment, we may use that information to time service-related communications, including collection kit timing, hospital and delivery preparation, enrollment completion reminders, and other information related to the cord blood and cord tissue banking services you have requested or are considering. These communications are made by StemCyte directly and are not sponsored by, or compensated by, any third party.
  • To comply with legal, regulatory, and accreditation obligations.
  • To improve our services, websites, and communications.
  • To conduct internal audits, quality assurance, and research.
  • To send marketing communications about other StemCyte products and services where permitted by law and consent.

We limit use of Sensitive Personal Information, including reproductive or sexual health application information, to purposes reasonably necessary to provide our services (including the service-related communications described above), to comply with law, and to ensure the safety and integrity of our operations. We do not use Sensitive Personal Information for marketing communications sponsored by, or compensated by, any third party.

Cookies & Tracking Technologies

We use cookies and similar technologies to:

  • Enable website functionality
  • Understand website usage and performance
  • Support advertising and analytics

You may manage cookie preferences through your browser settings. Some cookies may be placed by authorized third-party analytics or advertising partners.

We do not respond to "Do Not Track" signals.

Sharing and Disclosure of Information

We may disclose personal information to:

  • Service Providers: Vendors performing services on our behalf under written agreement, including email delivery, hosting, payment processing, and customer support.
  • Healthcare Providers: As authorized by you.
  • Affiliates: For consistent business operations.
  • Legal Authorities: When required by law, subject to the limitations described in Section 6.

We do not sell personal information.

We may "share" limited information for cross-context behavioral advertising as defined by California law, including general website-visitor retargeting through advertising platforms such as Google Ads and Meta. We do not use Sensitive Personal Information, including pregnancy details or expected due date, as the basis for cross-context behavioral advertising. You may opt out of such sharing at any time.

All the above categories exclude text messaging originator opt-in data and consent. SMS opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of text message services.

Section 5

Data Retention

We retain personal information only for as long as reasonably necessary to:

  • Fulfill the purposes described in this policy
  • Meet legal, regulatory, and accreditation requirements
  • Resolve disputes and enforce agreements

Retention periods vary depending on data type and legal obligations.

Section 6

Reproductive and Perinatal Health Information Protections

Consistent with California AB 1194 (effective January 1, 2024), we will not voluntarily disclose personal information relating to a consumer's accessing, procuring, or searching for services regarding contraception, pregnancy care, perinatal care, or related reproductive health services to law enforcement or governmental agencies pursuant to discretionary cooperation requests. We respond only to lawful processes that compel disclosure, and only to the extent legally required.

Consistent with California AB 254 (effective January 1, 2024) amending the Confidentiality of Medical Information Act (CMIA), where our digital services collect reproductive or sexual health application information, we treat that information as medical information under CMIA and apply CMIA's protections, including limitations on disclosure for purposes other than providing health care services.

Your Privacy Rights (California Residents)

California residents have the right to:

  • Know what personal information we collect
  • Access personal information
  • Correct inaccurate personal information
  • Delete personal information (subject to legal exceptions)
  • Limit use of Sensitive Personal Information
  • Opt out of sale or sharing of personal information
  • Not be discriminated against for exercising rights

Requests may be submitted to: customerservice@stemcyte.com. Identity verification may be required. Requests will be fulfilled within statutory timeframes.

Section 8

International Users

If you access our services from outside the United States, your information may be transferred to and processed in the U.S. We process international data in accordance with applicable laws and safeguards.

Section 9

Security Measures

We maintain administrative, technical, and physical safeguards designed to protect personal information. No system is completely secure; users are responsible for safeguarding login credentials.

Section 10

SMS Communications

We may send SMS (text) messages to individuals who opt in to receive them. SMS messages may include service reminders, event notifications, transactional updates, and marketing communications where you have provided consent.

SMS opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of text message services used to deliver messages on our behalf.

Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated policy at this URL and update the "Last Updated" date. For material changes, we will provide additional notice consistent with applicable law.
